1. INFORMATION COLLECTED
You may visit and browse the Sites without providing personally identifiable information about yourself. However, this may limit your ability to receive certain features, products or services from Us.
Information You Provide
We may collect Personal Information (information that can be used to identify you as an individual) such as your name, email, telephone number, home address, demographic information (such as zip code, age), or payment information (such as account or credit card number). The types of Personal Information we collect may vary depending on your use of the features of the Sites. If you register at the Sites, enter a promotion, opt–in to receive emails or other offers or communications, we collect and store the information provided. We may also ask you to provide other information, such as demographic information, such as gender, age or about your product preferences and interests.
Information We Collect Automatically
Mobile Apps: Some of our mobile apps include opt–in, geo–location services that provide location–based services, such as store locators, local weather, promotional offers and other personalized content. Some of our mobile apps include opt–in "push notifications." Most mobile devices allow you to turn off location services or push notifications. If you consent to location services, we will collect information about the Wi–fi routers closest to you and the cell IDs of the towers closest to you to provide the requested location–based service, not to identify you.
Site Usage Information: L’Oreal and its third–party service providers may also use a variety of technologies that passively or automatically collect information about how the Sites are accessed and used ("Usage Information"), including your browser type, device type, operating system, application version, the pages served to you, the time you browse, preceding page views, and your use of features or applications on the Sites. This statistical data helps us understand what is interesting and relevant to users of the Sites so we can best tailor our content.
Device Identifiers: Kiehl’s also automatically collects an IP address or other unique identifier information ("Device Identifier") for the computer, mobile device, technology or other device (collectively, "Device") you use to access the Sites. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Sites, help diagnose problems with our servers, analyze trends, track users’ web page movements, help identify you and your shopping cart, and gather broad demographic information for aggregate use.
Cookies: Like many Web sites, we use "Cookies," which are data files placed on a Device when it is used to visit the Sites to facilitate site navigation and to personalize your experience, including tailoring advertisements. Cookies may also be used to associate you with social networking sites like Facebook and Twitter and, if you so choose, enable interaction between your activities on the Sites and your activities on such social networking sites. We, or our vendors, may place cookies or similar files on your Device for security purposes, to facilitate site navigation and to personalize your experience while visiting our Sites (such as allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location, or demographic information).

2. INFORMATION FROM THIRD PARTIES
We may receive information about you from third parties that feature our products or promotional offers if you opt–in to receive information from us. You may also choose to participate in a third party application or social media site through which you allow us to collect (or the third party to share) information about you, including Usage Information and Personal Information.
3. USE AND SHARING OF INFORMATION
Kiehl’s uses the information we collect about you for a variety of business purposes, including:
- responding to your questions and requests
- providing you with access to certain areas and features of the Sites
- verifying your identity
- full–filling product purchases
- communicating with you about your account and activities on the Sites
- sending notice of changes to any Kiehl’s policy
- tailoring content, advertisements, and offers we provide you
- improving the Sites and for internal business purposes
- allowing you to log in with a social media account and share activities on your social media pages, such as Facebook

Third Parties Providing Services On Our Behalf. We may share your Personal Information with third parties that perform functions on our behalf (or on behalf of our partners) such as service providers that host or operate our Sites, analyze data, process transactions and payments, fulfill orders or provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions, contests, sweepstakes, surveys or provide marketing or promotional assistance. Your Personal Information may also be used by us or shared with our subsidiaries, affiliates, sponsors, partners, advertisers or other third parties to provide you with product information and promotional and other offers to help maintain and operate the Sites or for other reasons related to the operation of our business, including but not limited to the fulfillment of purchases, promotional offers, and administering contests.
Business Transfers. We may share your Personal Information with other entities and our affiliates in the family of companies controlled by L’Oreal USA, Inc. for internal reasons, primarily for business and operational purposes. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or our assets, or assets related to the Sites, Personal Information, Usage Information, and any other information that we have collected about the users of the Sites may be disclosed to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.
4. YOUR PRIVACY RIGHTS, CHOICE AND ACCESS.
You may direct us not to share your Personal Information with third parties, not to use your Personal Information to provide you with information or offers, or not to send you newsletters, e–mails or other communications by: (i) modifying your registered user information on the Sites; (ii) sending us an e–mail by clicking here; or (iii) following the removal instructions in the communication that you receive.
If you wish to modify, verify, correct, delete, or update any of your Personal Information collected through the Sites, you may edit your profile preferences or contact us at the above address or e–mail. In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Sites. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.
We will retain your information (including geo–location data) for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services contact us here. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We do not control certain privacy settings and preferences maintained by our social media partners like Facebook and Twitter. If you wish to make changes to those settings and preferences, you may do so by visiting the settings page of the appropriate social media site.
5. ADVERTISING/TARGETED ADVERTISING; HOW TO OPT–OUT
Kiehl’s licenses technology to serve advertisements on its own Sites and within its content as that content is served across the Internet. In addition, Kiehl’s may use third party network advertisers to serve advertisements and third party analytics vendors to evaluate and provide us with information about the use of the Sites and viewing of our content. We do not share Personal Information with these third parties, but ad network providers, the advertisers, the sponsors, and/or analytics service providers may set and access their own cookies, pixel tags and similar technologies on your Device and they may otherwise collect or have access to information about you, including Usage Information. We and our network advertisers may target advertisements for products and services in which you might be interested based on your visits to both the Sites and other web sites. We may use a variety of companies to serve advertisements.
If you prefer to not receive targeted advertising, you can opt out of certain network advertising programs through the Network Advertising Initiative (NAI) Opt–Out Page. Please note that even if you choose to remove your information (opt out), you will still see advertisements while you're browsing online. However the advertisements you see may be less relevant to you and your interests. Additionally, many network advertising programs allow you to view and manage the interest categories they have compiled from your online browsing activities. These interest categories help determine the types of targeted advertisements you may receive. The NAI Opt–Out Page provides a tool that identifies its member companies that have cookies on your browser and provides links to those companies.
The Sites are not directed to children under 13. We do not knowingly collect, use or disclose personally identifiable information from anyone under 13 years of age. If we determine upon collection that a user is under this age, we will not use or maintain his/her Personal Information without the parent/guardian’s consent. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.
7. SECURITY OF YOUR INFORMATION
Kiehl’s maintains reasonable safeguards to protect Personal Information against loss, unauthorized use, disclosure or destruction and when transferring information for processing. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information to you transmit to us. Kiehl’s restricts authorized access to your personal information to those persons who have a legitimate purpose to know that information to provide products or services to you and those persons you have authorized to have access to such information. We also require that third parties providing services on our behalf protect Personal Information and not use it for purposes other than providing assistance to Kiehl’s.

The Sites are governed by and operated in, and in accordance with the laws of, the United States, and are intended for the enjoyment of residents of the United States. L’Oreal makes no representation that the Sites are governed by or operated in accordance with the laws of any other nation. Given that we are an international business, our use of your information necessarily involves the transmission of data on an international basis. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the Sites, or providing us with any information, you (a) acknowledge that the Sites are subject to the laws of the United States, (b)consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws.

THESE Kiehl’s SINCE 1851 REWARDS PROGRAM TERMS AND CONDITIONS ARE EFFECTIVE AS OF SEPTEMBER 29, 2014.
The Kiehl’s Since 1851 Reward program ("Kiehl’s Since 1851 Rewards") is open to legal residents of the fifty (50) United states and District of Columbia who are 18 years of age or older at the time of registration. Void where prohibited.
Participation in the Kiehl’s Rewards program is voluntary. You need not join to purchase products at Kiehl’s and Kiehl’s does not maintain any personal information of yours if you do not join.
Membership in Kiehl’s Since 1851 Rewards and its benefits are offered at the discretion of Kiehl’s. Kiehl’s may, at any time, terminate, change, limit, modify or cancel Kiehl’s Since 1851 Rewards or any rules, regulations, benefits or conditions of participation by posting the modified rules on this page. Your continued participation in the program after such posting will constitute your acceptance. By enrolling in Kiehl’s Since 1851 Rewards, you hereby agree to these terms and condition, which may be updated from time to time by Kiehl’s in its sole discretion and that you meet the eligibility requirements. Changes to Kiehl’s Since 1851 Rewards or these Terms and Conditions will be communicated via email or on this web page.
Where to Enroll, Earn and Redeem Program Rewards
Membership in Kiehl’s Since 1851 Rewards and offers may be redeemed only for purchases made via Kiehls.com or in a Kiehl’s Retail Store. Purchases at Kiehl’s counters in department stores, spa services at Kiehl’s Spa 1851, services at The Kiehl’s Barbershop, other third party retailers, Travel Retailers, etailers, Kiehl’s By Mail are not eligible for the Kiehl’s Since 1851 Rewards program.
You may enroll in Kiehl’s Since 1851 Rewards through the Kiehls.com or in one of the Kiehl’s retail store locations. To enroll, you must provide your full name, email address and mailing address. Your enrollment will be confirmed with a welcome message at the email address provided which will include your Program enrollment information. Kiehl’s Reward Offers are based on dollars spent on qualifying Kiehl’s in store or Kiehl’s online purchases or other qualifying behaviors. You’ll receive:

Kiehl’s Since 1851 Reward Offers are valid for 60 days from eligibility/issuance and cannot be re-used, transferred, refunded or redeemed for cash (except where required by law) and must be redeemed in full, in a single purchase. Rewards Offers are not valid for use towards Kiehl’s gift certificates, charitable items, promotional value sets, spa services, barber services, sales tax or shipping charges or combined with any other offer. Kiehl’s Since 1851 Reward Offers may be redeemed once per annual enrollment year. Points accumulate from purchases made within one year of a member’s enrollment date. Any purchases made after the one year enrollment anniversary date will qualify for points in the subsequent member year, and every year after. Points are not carried over from year to year.
Members must have sufficient Points to redeem Kiehl’s Since 1851 Reward Offers. Points cannot be combined with cash or with another member’s Points to obtain a Kiehl’s Since 1851 Reward Offer. Kiehl’s reserves the right to limit the quantities of Kiehl’s Since 1851 Reward Offers redeemed by a single member in a given time period. Kiehl’s Since 1851 Reward offers can only be used by the recipient. In the event you return a purchase for which you received Points, Points will be deducted based on the dollar value of the return.
Kiehl’s may offer limited–time Kiehl’s Since 1851 Reward Offers or may make promotional offers selectively available to members, based on purchase activity, geographic location, program participation, or other factors.
From time to time, Kiehl’s may also provide members with an opportunity to earn additional Points or Kiehl’s Since 1851 Reward Offers through participation in site activities, features or by uploading user content in social media. In an effort to be always transparent with our Kiehl’s Since 1851 Reward Members and the public at large, we remind you that whenever you earn points, receive products or other incentives for participation, you must use appropriate words of disclosure, such as "Points Earned," "Free Sample Received," or similar words to indicate that you received value for from Kiehl’s Since 1851.
Kiehl’s reserves the right, without limitation, to terminate, change, limit, modify or cancel any of the above means of earning, with or without notice.
Unless otherwise stated, Points will be communicated to you via email on a monthly basis or accessible by logging on to your account on Kiehls.com. Points and Kiehl’s Since 1851 Reward Offers will mature 30 days after qualifying purchases. Rewards will be emailed upon eligibility following the end of the 30 day period. For example, if you reach 100 points on June 15, your points will mature on July 15 and you will receive your reward via email or access the reward on Kiehls.com on July 16.
Only one Kiehl’s Since 1851 Rewards Program account may be associated with a single email address. In the event of a dispute over ownership of Kiehl’s Since 1851 Rewards membership account, the registration will be declared to have been made by the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
By enrolling in Kiehl’s Since 1851 Rewards, you agree to provide true, accurate, current and complete information about yourself and maintain and promptly update the information to keep it true, accurate, current and complete. If you provide any data that is untrue, inaccurate, not current or incomplete, or if Kiehl’s, in its sole discretion, suspects that your registration data is untrue, inaccurate, or incomplete or that you are in any way abusing your membership in Kiehl’s Since 1851 Rewards, Kiehl’s reserves the right to suspend, terminate or refuse your participation.
Communications and Reviewing Your Account Information
As a member, you will periodically receive emails from Kiehl’s. You may opt–out of the marketing emails at any time, but operational emails will still be sent to you as it relates to your membership in Kiehl’s Since 1851 Rewards. Examples of these are: the welcome email, a Kiehl’s Since 1851 Reward confirmation email, a monthly Points balance email, or other communications that help us to ensure that your account is monitored.
General Program Conditions and Exclusions
Points and Kiehl’s Since 1851 Reward Offers cannot be redeemed for cash at any time (unless required by law).
Offers may not be used towards purchases of gift sets, Kiehl’s gift certificates, charitable items, promotional value sets, spa services, barber services, sales tax, or shipping charges. Offers may not be combined with other Kiehl’s promotional offers. Redemption offers are time–limited or available only in limited quantities.
Points may not be combined with another member’s Points, transferred, of sold. Points have no cash value and cannot be redeemed for cash at any time. Points have no purpose or use other than in exchange for benefits, products or services offered by Kiehl’s.
Points are not valid unless earned in strict compliance with the requirements set forth and intended by Kiehl’s, and member shall not attempt to earn points by any means (including without limitation, by using any script, bot, data mine or other automated means) that only simulates applicable requirements. In the case of a dispute regarding the Points available to any member, Kiehl’s decision will be final. Upon termination of membership for any reason, all points will be forfeited and Kiehl’s will not provide cash equivalent for rewards or Points.
By enrolling in Kiehl’s Since 1851 Rewards, you agree not to (a) take any action or (b) upload, post, submit or otherwise distribute or facilitate distribution of any User Content (including text, communications, software, photographs, videos, sound recordings, data or other information) using any communications service, discussion forum, or other feature available on or through Kiehl’s Since 1851 Rewards, in any manner, that is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, invasive of another's privacy, tortious, obscene, profane, infringes on any patent, trademark, trade secret, copyright, right of publicity, right of privacy, any other right of any party or which otherwise violates Kiehl’s Site Terms and Conditions or any Other Agreement;
You further agree not to (a) upload any content that imposes an unreasonable or disproportionately large load on Kiehl’s computing, storage or communications infrastructure, or attempts to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or otherwise; (b) contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of Kiehl’s, or any third party; (c) creates Member accounts by any automated means or under false pretenses or impersonates any person or entity, including an employee or representative of Kiehl’s; (d) harvests, scrapes or collects any information from Kiehls.com.
Kiehl’s is not responsible for requests or correspondence lost or delayed in the mail.
Kiehl’s, its parent L’Oreal and subsidiaries and affiliate entities, and their respective officers, directors, employees, and agents (the "Released Parties") make no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to Kiehl’s Since 1851 Rewards or membership in Kiehl’s Since 1851 Rewards. By participating in the Kiehl’s Since 1851 Rewards Program, each member hereby releases the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to that member’s participation in Kiehl’s Since 1851 Rewards, use of points or rewards, or agreement to these Terms.
Kiehl’s is not responsible for problems related to any of the equipment or programming associated with or utilized by the member; any human error; any interruption, deletion, omission, defect or failure of any network or electronic transmission for whatever reason.
This Program and these Terms will be governed by and construed under the substantive laws of the State of New York, without reference to conflict–of–laws considerations. Kiehl’s and member each agree that any dispute, claim, or controversy arising from or relating to this Program and these Terms or member’s Program membership will be resolved by binding arbitration conducted in the State of New York. Kiehl’s and member each acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim, or controversy. Kiehl’s and member each understand that a judgment on any arbitral award may be entered in any court having jurisdiction. No arbitration under this Program and these Terms will be consolidated with any other arbitration.
